Overview:

You are hiring SUNDIAL STUDIOS to design and/or and develop a web site or custom logo for the total price of the order you are about to place or have recently placed.

What do both parties agree to do?

As our customer, you have the power and ability to enter into this contract on behalf of your company or organization. You agree to provide us with everything that we need to complete the project including text, images and other information as and when we need it, and in the format that we ask for. You agree to review our work, provide feedback and sign-off approval in a timely manner; which in our world is within two business days.

We have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner. Along the way we will endeavor to meet all the deadlines set but we can't be responsible for a missed launch date or a deadline if you have been late in supplying materials or have not approved or signed off our work on-time at any stage. On top of this we will also maintain the confidentiality of any information that you give us.

Deadlines work both ways, and just as we are committing to completing your project in the time-frame spelled out in your order, you will also be bound by any dates that we set together.

Getting down to the nitty gritty...

Design

Websites: We will create a design for the look-and-feel, layout and functionality of your web site from one of the versions available. 
Logo: We will use our network of graphic designers and project manage the process of providing you with multiple versions of a new logo design that you can choose from.  

Compatibility

We test and insure that your website functions and displays correctly on IE7, Firefox 4, Safari 4, Opera 10 and Google Chrome 5 and is W3C XHTML 1.0 Transitional and W3C CSS Valid (that means it will works with current web technologies). If you need your website to show the same design to visitors using older browsers (IE 6 or Firefox 2), we can do this and will charge you at an hourly rate of $125 per hour.

Although we may have the experience and ability to write a best-seller, we are not responsible for writing, creating or inputting any text copy for your project unless we specified it in the original order. We are happy to help though, and in addition to the original order we charge $295 per page for copywriting or content input.

Photographs

You will supply us with website images that are at least 1,000 pixels wide, and in JPG, PNG, PDF or PSD file format (you cannot stretch images, so the originals need to be at last 1,000 pixels wide). If you choose to buy stock photographs we can suggest vendors of stock photography. Any time we spend searching for appropriate photographs will be charged at $85 per hour plus the cost of the images.

Changes and revisions

The prices at the beginning of this document are based on the number of days that we estimate we'll need to accomplish everything that you have told us you want to achieve. If you want to change your mind on the design, add extra pages or templates or even add new functionality, that won't be a problem. You will be charged at an hourly rate of $125 per hour.

Technical support

We are not a web site hosting company and so we do not offer or include technical support for web site hosting, email or other services relating to web site hosting. If you do require help with anything beyond the design and development of your site, we'll be happy to help and will charge you $125 per hour.

Copyrights

You guarantee to us that any and all elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by you or that you have permission to use them.

Copyright is assigned as follows:

• You own the graphics and other visual elements that we create for you for this project. We will give you a copy of all files and you should store them really safely as we are not required to keep them or provide any native source files that we used in making them.
• You also own text content, photographs and other data you provided, unless someone else owns them. We own the XHTML markup, CSS, PHP and all other code and we license it to you for use on this individual project only.
• We love to show off our work and share what we have learned with other people, so we reserve the right to display and link to your completed project as part of our portfolio and to write about the project on websites, blogs, social networking websites, in magazine articles and in any books we may write.

Legal stuff

We can't guarantee that the functions contained in any website, web-page templates, widgets, ecommerce components, payment processors or in a completed web site will always be error-free and therefore we can't be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised us of the possibilities of such damages.

We do not offer refunds for orders placed through our website or any work started, even if that work has not yet been submitted for your review. However, we are happy to work with you should you change your mind on the direction and/or scope of your project.
